TRUST ECO-PV

The Trust of Eco-PV, calls “TRUST ECO-PV”, established in accordance with GSE Technical Regulations and with IV and V Conto Energia, is a non-attachable and controlled fund where the Responsible Person can pay the amount of Financial Guarantee for its incentivated photovoltaic modules or the Producer – in according to Decree No. 49/2014 – can pay eco-contribution for end-of-life photovoltaic modules placed on market.

TRUST ECO-PV is a real “transparent safe”: the amount is used only for pickup, transport and treatment services of guarantee modules. Cannot be used for no other reason.

The TRUST ECO-PV is subjected to double check of flows of paid amounts, as follows:

• the Trustee, external person, with necessary requirements of professionalism and morality, manages the amount transfer from Trust to Consortium availability only when there is a need to manage the guaranteed phovoltaic modules end-of-life;
• the Guarantor, “super partes” person outside of Consorzio, with high morality and competence, who verifies fulfillment of obligations about the management of TRUST ECO-PV, and verifies fulfillment of obligations by Eco-PV.

Each amount of Financial Guarantee or eco-contribution immobilized into TRUST ECO-PV is linked to single module guaranteed, identified by serial number. Eco-PV ensures that every single module have exactly the amount paid by Responsible Person or Producer.

Also, both in case of Financial Guarantee and eco-contribution, Eco-PV issues a certificate of payment that documents the amount immobilized into Trust for every photovoltaic module identifified by its serial number.

How to use Trust for Responsible Person

In according to Decree No. 49/2014, to ensure the financing of correct management of end-of-life photovoltaic modules incentivated in Conto Energia, the Gestore dei Servizi Energetici (GSE) retains from incentives, in the last ten years of entitlement to the incentive of the Responsible Person, an amount of Financial Guarantee to cover the operating cost of waste. The GSE deduction is returned to Responsible Person only if it is established the fulfillment of obligations

With Decree No. 118/2020, the Responsible Person of incentivated plant in Conto Energia can pay the Financial Guarantee into Trust of Collective System, recognized by Ministero della Transizione Ecologica. The Trust must have the requirements of GSE Technical Regulations.

How to use Trust for EEE Producer

Born as tool to immobilize the Producer’s Financial Guarantee of photovoltaic modules incentivated in IV and V Conto Energia (DM 5 may 2011 and DM 5 july 2012), with law no. 221/2015 – “Collegato Ambientale” – the Ministero dell’Ambiente e della Tutela del Territorio e del Mare, now Ministero della Transizione Ecologica, imposed the Trust as financial tool mandatory for immobilization of eco-contribution payed by Producers of photovoltaic modules placend on market (EEE). The Trust must have the requirements of GSE Technical Regulations.
